Alternative Means for Resolving Disputes Arising from Trading in the Securities Market (A Comparative study)
Abstract
Disputes arising from trading in the stock market are among the most significant challenges to the stability of financial markets and investor confidence, particularly for listed companies and regulatory bodies. This issue is further compounded by the complexity and rapid pace of financial transactions. To avoid prolonged litigation under traditional judicial procedures, alternative dispute resolution (ADR) methods have emerged as effective and efficient solutions. These methods combine speed, efficiency, and flexibility while ensuring the confidentiality of procedures and market information. ADR mechanisms include various approaches such as mediation and arbitration, which are designed to address disputes of different natures—whether technical or financial—through the expertise of specialized professionals within a flexible legal framework. This enhances a secure investment environment, reduces costs and time, and collectively establishes a comprehensive judicial system that supports the sustainability of the stock market while safeguarding the rights of all parties without resorting to conventional litigation.
