Legal Means Employed by the Iraqi and French Legislators to Deter Abuse of Office: A Comparative Study

الملخص

This research addresses the legal measures implemented in both Iraq and France to deter abuses of public office, by analyzing the applicable legislations and enforcement mechanisms in each legal system. The study aims to understand how each system addresses this critical issue and the effectiveness of the procedures in promoting accountability and oversight of public officials.

The research includes a comprehensive comparison of the legal foundations, regulatory controls, and penalties imposed for abuses. An analytical and comparative approach was employed to assess the impact of these measures on reducing corruption and enhancing integrity in governmental work.

The findings indicate that the French system possesses stricter and more transparent mechanisms, contributing to a greater effectiveness in deterring abuses compared to the Iraqi system, which faces challenges related to the enforcement of laws and the activation of oversight. Based on these findings, the research concludes with recommendations aimed at strengthening laws and mechanisms in Iraq to achieve higher levels of accountability and transparency.
